The Terms apply to all users of our website, including without limitation, users who are browsers, customers, merchants, vendors and/or contributors of content. If you access and use this website, you accept and agree to be bound by and comply with the Terms and our Privacy Policy. If you do not agree to the Terms or our Privacy Policy, you are not authorized to access our website, use any of our website's services or place an order on our website.

We reserve the right, in our sole discretion, to refuse orders, including without limitation, orders that appear to be placed by distributors or resellers. If we believe that you have made a false or fraudulent order, we will be entitled to cancel the order and inform the relevant authorities.

We do not guarantee the accuracy of the colour or design of the products on our website. We have made efforts to ensure the colour and design of our products are displayed as accurately as possible on our website.

The Terms and any documents expressly referred to in them represent the entire agreement between you and us in relation to the subject matter of the Terms and supersede any prior agreement, understanding or arrangement between you and us, whether oral or in writing. Both you and we acknowledge that, in entering into these Terms, neither you nor we have relied on any representation, undertaking or promise given by the other or implied from anything said or written between you and us prior to such Terms, except as expressly stated in the Terms.

Our failure to exercise or enforce any right or provision of the Terms will not constitute a waiver of such right or provision. A waiver by us of any default will not constitute a waiver of any subsequent default. No waiver by us is effective unless it is communicated to you in writing.

Any headings and titles herein are for convenience only.

14. Severability

If any of the provisions of the Terms are determined by any competent authority to be invalid, unlawful or unenforceable, such provision will to that extent be severed from the remaining Terms, which will continue to be valid and enforceable to the fullest extent permitted by law.

15. Overview of the Feature

The feature allows card owners to set up paid appointments or consultations through their CardGit profile. Clients can book appointments, make payments via a payment gateway, and answer custom questions set by the Card Owner. CardGit charges a 5% processing fee on all transactions disburses funds to the Card Owner after the appointment.

16. Eligibility

Card Owners must have a valid CardGit account and provide accurate payment information to receive payments.
Clients must provide accurate payment information to book an appointment. Users must be at least 18 years old.

17. Card Owner Responsibilities

Setup: Card Owners are responsible for accurately configuring their availability, pricing, and custom questions in the CardGit platform.
Payment Information: Card Owners must provide valid and up-to-date payment details for payment disbursement. CardGit is not responsible for delays or errors due to incorrect account information.
Service Delivery: Card Owners must honor scheduled appointments and provide services as agreed with Clients.
Compliance: Card Owners must comply with all applicable laws, including tax obligations related to payments received.

18. Client Responsibilities

Booking: Clients must provide accurate information when booking an appointment, including answers to custom questions set by the Card Owner.
Payment: Clients agree to pay the appointment fee through the the provided payment gateway.
Attendance: Clients must attend the scheduled appointment or notify the Card Owner in advance if unable to attend.

19. Payment Processing

Payment Gateway: All payments are processed through secure payment gateways.
Platform Fee: CardGit deducts a 5% fee from the total payment amount for each transaction.
Payment processing fees: They could be additional charges from payment providers.
Disbursement: Payments (minus the platform fee and payment processing fees) are disbursed to the Card Owner’s designated payment details after the appointment

20. Notification

Card Owners will receive notifications via their CardGit dashboard and email for new bookings, payment, and fund disbursements.
Clients will receive email confirmations for bookings, payments, and appointment details.
CardGit is not responsible for delivery failures due to incorrect email addresses or technical issues beyond our control.

21. Cancellations Rescheduling and Refund

By Card Owners: Card Owners may cancel or request client (person who has booked an appointment) to reschedule appointments.
When a card owner cancel appointments at any time, the client receives 100% full refund.

By Card-owner’s Clients: Clients may cancel or reschedule appointments.
1. If a client cancels the appointment AT LEAST 24 hours before appointment, client receives full refund. However, some card users can mark certain appointments types as non-refundable (express consultations or heavily discounted slots).
2. If client cancels appointment within 12-24 hours before the appointment time, the client receives 50% refund.
3. No refund: If canceled LESS THAN 12 hours before the appointment time, the client does not receive any refund.
4. No-Shows: If a client fails to attend an appointment without prior cancellation, the payment is non-refundable unless otherwise specified by the Card Owner.
5. A client can reschedule once for free with a particular card owner for a particular booking, if done MORE THAN 12 hours before the appointment time. After that, rescheduling counts as a cancellation. (subject to refund policy).
Refunds are processed back to the original payment method.

22. Liability

CardGit’s Role: CardGit acts solely as a platform facilitating appointment scheduling and payment processing. We are not responsible for the quality, delivery, or outcome of services provided by Card Owners.
Disputes: Any disputes between Card Owners and Clients must be resolved directly between the parties. CardGit may assist in facilitating communication but is not liable for resolving disputes.
Technical Issues: CardGit is not liable for technical issues, such as platform downtime or payment processing errors, that are beyond our reasonable control.

23. Prohibited Activities

Users may not:
• Use the Feature for illegal or unauthorized purposes.
• Provide false or misleading information during setup or booking.
• Attempt to bypass CardGit’s payment gateway or processing fees.
• Engage in fraudulent activities, including chargebacks or unauthorized payment reversals.

24. Privacy

CardGit collects and processes personal data in accordance with our Privacy Policy. By using the Feature, you consent to the collection, storage, and sharing of data (e.g., payment details) as necessary to provide the service.

25. Termination

CardGit reserves the right to suspend or terminate access to the Feature for any User who violates these Terms or engages in activities that harm the platform or other Users.

26. Governing Law

Any disputes arising out of or relating to the Terms, the Privacy Policy, use of our website, or our products or services offered on our website will be resolved in accordance with the laws of the Province of Nigeria without regard to its conflict of law rules. Any disputes, actions or proceedings relating to the Terms or your access to or use of our website must be brought before the courts in the City of Lagos, Nigeria and you irrevocably consent to the exclusive jurisdiction and venue of such courts.

27. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page.
